THIS NOTICE DESCRIBES HOW MEDICAL AND DENTAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Our Commitment to Your Privacy
West Jersey Oral & Maxillofacial Surgeons understands that your medical and dental information is personal. We are required by law to:
- Maintain the privacy of your protected health information (PHI);
- Provide you with this Notice of our legal duties and privacy practices;
- Follow the terms of this Notice currently in effect.
We reserve the right to change our privacy practices and the terms of this Notice at any time. Any revised Notice will apply to all PHI we maintain and will be available in our office and on our website, if applicable.
How We May Use and Disclose Your Protected Health Information
1. Treatment
We may use and disclose your PHI to provide, coordinate, or manage your oral and maxillofacial surgical care. For example:
- Communicating with your general dentist or physician
- Consulting with specialists
- Sharing information with anesthesia providers
- Reviewing radiographs, CBCT scans, pathology reports, or lab results
2. Payment
We may use and disclose your PHI to obtain payment for services provided, including:
- Billing dental or medical insurance companies
- Verifying coverage and eligibility
- Submitting claims for surgical procedures
- Collection activities permitted by law
3. Health Care Operations
We may use and disclose your PHI for practice operations, including:
- Quality assessment and improvement activities
- Staff training and credentialing
- Compliance and risk management
- Business planning and administrative activities
4. Other Uses and Disclosures Permitted or Required by Law
We may disclose PHI without your written authorization when required or permitted by law, including:
- Public health reporting
- Reporting abuse, neglect, or domestic violence
- Health oversight activities
- Law enforcement purposes
- Judicial or administrative proceedings
- To prevent or lessen a serious threat to health or safety
- Workers' compensation claims
Special Protections for Substance Use Disorder (SUD) Records (42 CFR Part 2)
If our Practice creates, receives, or maintains records related to substance use disorder (SUD) diagnosis, treatment, or referral that are subject to 42 CFR Part 2, those records are afforded additional confidentiality protections.
Uses and Disclosures of Part 2 Records
We may use or disclose Part 2 records for treatment, payment, and health care operations as permitted by HIPAA and applicable federal law.
Restrictions on Use in Legal Proceedings
Part 2 records may not be used or disclosed in any civil, criminal, administrative, or legislative proceedings against you unless:
- You provide written consent, OR
- A court issues a specific order after notice and an opportunity for you (or the record holder) to be heard.
A subpoena alone is not sufficient without a proper court order meeting federal requirements.
Redisclosure
Information disclosed to someone not subject to HIPAA or Part 2 protections may be redisclosed and may no longer be protected by federal privacy laws.
Your Rights Regarding Your PHI
You have the following rights:
Right to Inspect and Copy
You may request access to your PHI maintained by our Practice.
Right to Amend
If you believe your information is incorrect or incomplete, you may request an amendment.
Right to an Accounting of Disclosures
You may request a list of certain disclosures of your PHI made by our Practice.
Right to Request Restrictions
You may request restrictions on certain uses or disclosures. We are not required to agree, except where required by law (such as certain self-pay restrictions).
Right to Confidential Communications
You may request that we contact you at a different address or by alternative means (for example, work phone only).
Right to a Paper Copy
You may request a paper copy of this Notice at any time, even if you agreed to receive it electronically.
